The Arbitrator's Iron Hand: Modern Approaches to Case Management

EPAM Law invites you to take part in the business discussion “The Arbitrator's Iron Hand: Modern Approaches to Case Management”, which will focus on the growing role of arbitrators in managing proceedings and the search for a balance between efficiency and the parties’ procedural safeguards.

The development of technology and the related procedural opportunities available to parties inevitably carries the risk of abuse, with parties seeking to make proceedings as burdensome as possible for their opponents and prevent arbitrators from identifying the substance of a dispute amid a flood of excessive requests and applications.

It is therefore unsurprising that arbitration today increasingly requires active, and sometimes highly robust, procedural management — from strict control of deadlines, submission rounds and the volume of materials filed, to adapting evidentiary procedures to the specific circumstances of each dispute.

During the discussion, participants will consider where the line lies between necessary procedural discipline and the risk of infringing the parties’ right to properly present their case, as well as which tools are genuinely effective. The round-table participants will share practical experience and discuss approaches that allow procedural control to be maintained without compromising fairness and equality between the parties.
