EPAM redefends the interests of OAO Transammiak in a dispute with a largest manufacturer of fertilizers again

The litigation team of EPAM have successfully defended the interests of OAO Transammiak in a litigation with Minudobreniya JSC.  

The dispute has arisen due to the terms provided for by Minudobreniya JSC’s draft agreement being unacceptable for OAO Transammiak: the price set out in the new agreement had been much lower than the previous one, while the suggested pumping volume had been multiplied by two. As per the suggested agreement, OAO Transammiak was to transport Minudobreniya JSC’s liquid ammonia against the other counterparties’ interests, including those of Togliattiazot.

On December 15, 2014 the Samara Region Arbitrazh Court dismissed Minudobreniya JSC’s claim to compel OAO Transammiak to enter into an agreement for transport of liquid ammonia on hard terms when reviewing the case.

The result was achieved namely thanks to the Firm’s strategic efforts, since performance of the new agreement for transport of ammonia jeopardized the industrial safety and kept the Client from performing  its contractual obligations to OAO Transammiak’s other counterparties.

The Client’s interests were represented by Senior Associates Maria Kobanenko and Alina Kudriavtseva, Associates Olga Denchenkova and Denis Golubev. The overall coordination of the project was supervised by Partners Natalia Korosteleva and Valery Eremenko. 

The Firm had earlier managed to achieve the negation of judicial acts issued in the case against the Firm’s clients in the Presidium of the Supreme Arbitrazh Court of the Russian Federation.
