EPAM successfully defended the interests of its client in Russian and Belorussian courts

Litigation team of EPAM has successfully defended the interests of its client in the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation (ICAC) and in further proceedings, having managed to recover from Belorussian ODO Mostra Group about 100 million rubles in debts assigned by Nestle Russia LLC to Crobotol Investments Limited.

Following close consideration by the Minsk Commercial Court of the background of the arbitration award issued by the ICAC on June 18, 2013, the Firm’s Minsk office team managed to get the award recognized in the Republic of Belarus and to obtain from the Minsk Commercial Court a writ of execution to enforce the ICAC’s award.

On 8 August 2013, the Supreme Commercial Court of the Republic of Belarus upheld the decision of the Minsk Commercial Court recognizing and enforcing the ICAC’s award and dismissed the appeal brought by ODO Mostra Group against the decision of the Minsk Commercial Court.

The Firm’s lawyers have also succeeded in defending the interests of Crobotol Investments Limited and Nestle Russia LLC in the course of parallel proceedings brought in a Russian court by ODO Mostra Group challenging the assignment agreement that served as a basis of the Client’s claims. In December 2013, the Moscow District Federal Arbitrazh Court upheld the decisions of the first and appellate instance courts that had earlier dismissed the claims, thus removing any hindrances in recovering the debt from the opponent.

The client’s interests were represented by the joint team of Moscow and Minsk-based lawyers of EPAM under the lead of Partners Dmitry Dyakin and Denis Turovets. The team comprised Senior Associates Pavel Sadovsky, Igor Odinets, Associate Maxim Kuzmin and Junior Associate Elena Lebedeva.
