Attorneys of Egorov Puginsky Afanasiev & Partners successfully protect a large Russian holding in a precedent-setting dispute with a competitor

In the course of the FAS Russia (Federal Antimonopoly Service) proceedings, the Firm’s antimonopoly team succeeded in proving that the marketing program of our client’s competitor was in conflict with anti-monopoly laws. The program involved the competitor encouraging supermarket employees to promote goods in an attempt to circumvent trade law requirements, however, these actions were found to be in violation of fair competition rules.

The participants of this program were instructed to place certain store goods in the most conspicuous places on supermarket shelves, in addition to other promotional measures, in exchange for payment from the goods’ manufacturer. Attorneys of the Firm also proved that such actions were in conflict with the existing promotion-related business practices on the market, including those in place in bars and restaurants.

The client was represented before the FAS Russia by Competition Law Practice Counsel Denis Gavrilov, Associate Natalia Gavrilova and Paralegal Denis Kislitsa under the supervision of Partner Dmitry Dyakin.
