LLC Torex had sold the steel products to Global Metcorp, but then failed to deliver them. Later, LLC Torex was declared bankrupt, so Global Metcorp initiated the recovery of accounts receivable from the debtor.
The bankruptcy trustee filed an application to challenge the contract in the amount for over RUB 900m, on which the client’s claims were based and were included in the register of creditors. The bankruptcy trustee and the creditors tried to imply that the contract and all related documents were allegedly falsified by Global Metcorp, and the relationship with the debtor was fabricated.
EPAM legal team proved the relationship between Global Metcorp and LLC Torex was real and that there are no grounds for invalidating the contract.
