EPAM Litigation Practice Lawyers successfully defend a major Russian Pharmaceutical Holding

Litigation practice lawyers from EPAM successfully defended BIOTEK, a major Russian pharmaceutical holding, in a challenging an IP dispute.

On September 26, 2012, the Federal Arbitrazh Court for the Moscow District dismissed a cassation appeal filed by F. Hoffmann - La Roche AG that sought the reversal of judgments previously granted to the Firm’s client.

F. Hoffmann - La Roche AG alleged that BIOTEK had infringed on its patented invention rights and sought a freezing order to ban sales of oncology medication Tutabin. Following an in-depth study of the issue, the Firm’s experts could formulate a legal position that convinced the court that the plaintiff’s patent rights were not infringed upon as the medication did not accommodate every feature of F. Hoffmann - La Roche AG invention.
