A team from the Litigation Practice at the St. Petersburg office of Egorov Puginsky Afanasiev & Partners defended the interests of airline Aviastar-TU, the largest cargo airlines in Russia, in a long-standing dispute over the performance of an aircraft engine maintenance contract.
In the course of maintaining the engines of the Client’s fleet, the maintenance company had, over a long period, sought to revise the contract terms, invoicing for work beyond the scope of the contract. Moreover, the cost of works was calculated on the basis of highly excessive rates that had been set unilaterally by the maintenance company for years.
Following lengthy proceedings to settle the dispute, the courts upheld the position of the Firm’s Client regarding interpretation of the contract terms on payment for engine running time, and held that the maintenance company was acting unlawfully.
