Interpretation of Article V of the New York Convention by Russian Courts (Due Process, Arbitrability, and Public Policy Grounds for Non-Enforcement)

The Special New York Convention Number of the Journal of International Arbitration (Volume 25, Number 6, December 2008) - including 19 articles – is dedicated to the New York Convention. It provides a global snapshot of the Convention’s implementation fifty years on, with a particular focus on how the provisions of Article V of the Convention are being interpreted and applied by courts around the world.

Article by Ilya Nikiforov highlights the most recent trends involving the application of Article V of the New York Convention in Russia. It also considers three potential obstacles to enforcement of foreign arbitral awards in Russia, due process, arbitrability, and public policy.
