Seminar ‘Real Estate Mortgage and Mortgaged Property Trades: How to Avoid the Traps’

We would like to invite you to participate in a seminar on ‘Real Estate Mortgage and Mortgaged Property Trades: How to Avoid the Traps’, organized by EPAM with the support of the Russian Guild of Managers and Developers and the Auction House of the Russian Federation. The event will take place on 12 April 2016 (Tuesday) from 10:00 to 13:30 at the Grand Auction Hall of the Russian Auction House: 5B Grivtsov Lane, St. Petersburg.

It is well known that the majority of construction and real estate development projects are implemented with borrowed assets and that land titles, previously constructed buildings or structures, and unfinished buildings may serve as security for creditors.

When commercial banks obtain the rights to mortgaged property as a result of the debtor’s inability to make payments towards the loan, they seek to dispose of their non-core assets. Mortgaged property may also be sold during a debtor’s bankruptcy. Quite often, real estate developers sell mortgaged property themselves in order to improve their financial situation.

If you plan to buy real estate or land plots for construction, it makes sense to check if they are pledged as security and examine the terms of the agreement with the creditor. Otherwise, you are putting yourself at risk of getting bogged down in negotiations with the real estate seller and his creditors, only to be left with nothing in the end.

How can a developer build a relationship with a bank and not lose rights to the mortgaged property in the event of a temporary downturn in his financial situation? How can a bank ensure that it will not be left empty-handed if a creditor goes bankrupt? What is the procedure for a foreclosure sale, and how can a buyer obtain guarantees of proper registration of title?
