The litigation team at Egorov Puginsky Afanasiev & Partners has successfully defended FGKU North-West Directorate for Construction, Reconstruction and Renovation of the Russian Ministry of Culture in a litigation seeking to recover around 300 m rubles.
Due to the violations committed by Story Soyuz SV LLC at the construction of the Maly Drama Theatre’s New Stage in St Petersburg, the North-West Directorate has unilaterally withdrawn from the government contracts and sought to the unearned portion of the down payment and the penalties accrued totally amounting to 230 million rubles from the bad-faith contractor in court.
The respondent filed a counter-claim seeking to invalidate the unilateral withdrawal, to terminate the contract and to recover 70 m rubles in damages.
The first-instance and the appellate courts have fully satisfied the contractor’s claims and dismissed the client’s initial claim.
On December 21, 2017, attorneys of the Firm managed to defend the North-West Directorate’s rights in the North-West District Arbitrazh Court, the cassation appeal drafted by attorneys of the Firm was satisfied, earlier judgments cancelled and the case remanded for a retrial at the first-instance court.
